Terms & Conditions — SkyWatchNetwork

General Provisions

These Terms & Conditions govern all contracts, quotations, memberships, event participation, and deliveries of products and services provided by SkyWatchNetwork (hereafter "we" or "us") to our members, organizers, event attendees, and customers (hereafter "you"). By joining our network, attending an event, or purchasing or renting equipment, you agree to be bound by these terms. They replace any previous agreements or understandings.

All prices are in Euros (€) unless otherwise stated.

Quotations & Pricing

All quotations provided via email or WhatsApp are valid for thirty (30) days from the date of issue, unless otherwise stated. Prices for products are quoted Ex-Works (EXW) from our manufacturing partners, or as explicitly specified. Rental fees and event tickets are quoted separately.

Prices do not include (unless explicitly agreed in writing):

Import duties
VAT
Shipping costs
Installation costs

We reserve the right to adjust prices due to unforeseen currency fluctuations or raw material cost increases prior to order confirmation.

Orders, Memberships & Payment

Upon acceptance of your order, membership application, or event registration, we will issue a formal confirmation. Payment terms are:

Strictly net 30 days from the invoice date for established business accounts
100% advance payment via bank transfer for first-time orders, samples, rentals, and memberships
Event tickets must be paid in full prior to the event

We reserve the right to require partial payment before shipping large or custom orders. Ownership of purchased goods remains with SkyWatchNetwork until full payment has been received.

Event Participation

By attending a SkyWatchNetwork event, you agree to the following:

You participate at your own risk
You follow all safety instructions provided by the organizer
You do not look directly into the searchlight beam
You do not point any equipment at aircraft, vehicles, or people
You are responsible for your own safety and the safety of any minors accompanying you
SkyWatchNetwork and its organizers are not liable for injury, loss, or damage arising from your participation

Weather and Cancellation: Events may be canceled or rescheduled due to adverse weather conditions. In such cases, tickets will be refunded or transferred to a future event.

Rental Terms

When you rent equipment from SkyWatchNetwork, you agree to the following:

You are responsible for the safe and proper use of the equipment
You will not modify, disassemble, or attempt to repair the equipment
You will return the equipment in the same condition as received (normal wear and tear excepted)
You are liable for any damage, loss, or theft of the equipment during the rental period
A security deposit may be required prior to rental
Rental fees are non-refundable once the equipment has been delivered or picked up
A signed Rental Agreement is required before equipment is released

Organizer Responsibilities

Organizers who host events under the SkyWatchNetwork name agree to:

Follow all safety guidelines provided by SkyWatchNetwork
Ensure all participants are informed of safety rules
Operate the searchlight responsibly and in compliance with local laws
Report any incidents or accidents to SkyWatchNetwork
Not use the equipment for illegal or harmful purposes
Hold SkyWatchNetwork harmless from any claims arising from their events
Carry their own liability insurance for events

Delivery & Risk (for Purchased Products)

Delivery dates are estimates provided in good faith by our manufacturing partners. We are not liable for delays caused by:

Customs clearance
Shipping carriers
Acts of God
Supply chain disruptions

Risk of loss or damage to purchased products passes to you:

Upon delivery to the carrier (FOB shipping point for EXW terms)
Upon delivery to your specified address (for CIF/DDP terms)

We recommend you arrange appropriate insurance for high-value shipments.

Installation Services

If we perform on-site installation or commissioning services, these will be quoted separately. We perform services with professional care using qualified technicians. However, we cannot be held liable for:

Pre-existing faults in your electrical system
Third-party interference
Damage caused by improper use of the equipment after our work is completed

All installation work is subject to a separate service agreement.

Warranty & Returns (for Purchased Products)

We pass through the manufacturer's warranty (typically 18 months for searchlight systems, as specified in our product data sheets). This warranty covers manufacturing defects in materials and workmanship.

It does not cover damage caused by:

Improper installation
Misuse or neglect
Unauthorized modifications
Lightning strikes or power surges

Defective units must be returned to us for inspection and repair. Return shipping costs are the responsibility of the buyer unless we determine the defect is covered under warranty.

Intellectual Property

All content on the SkyWatchNetwork website, including text, images, logos, and designs, is the property of SkyWatchNetwork and may not be reproduced, distributed, or used without prior written permission.

Changes to These Terms

We reserve the right to update or modify these Terms & Conditions at any time without prior notice. The latest version will always be posted on this page. Continued use of our services after changes constitutes your acceptance of the new terms.

Severability

If any provision of these Terms & Conditions is found to be unenforceable or invalid, the remaining provisions will remain in full force and effect.

Limitation of Liability

To the maximum extent permitted by Dutch and EU law, SkyWatchNetwork's total liability is limited to the invoice value of the product giving rise to the claim, or the ticket price for events, whichever is applicable. We are not liable for any indirect, consequential, or incidental damages, including but not limited to:

Loss of profits
Loss of data or documentation
Downtime
Any other secondary losses resulting from the failure of our products, events, or services

Governing Law

These Terms & Conditions are governed exclusively by the laws of the Netherlands. Any disputes arising from our contract, events, or services shall be submitted to the competent court of Rotterdam, The Netherlands.
